The tabs below provide a variety of links to application and permitting-related information under the Asbestos Control Program. Included are links to assist building owners and contractors working in Montana with applying for asbestos project permits, making demolition notifications, and obtaining information and news about asbestos-related activities.

The NESHAP, Montana Code Annotated, and Montana Administrative Rules define the requirements for facility asbestos-related renovation and building demolition activities. Prior to any activity of renovation or demolition being conducted on or in facilities, an asbestos survey must be conducted, by a Montana-accredited asbestos inspector, to determine the presence of asbestos in or on the portion of the facility to be affected. Any asbestos containing material (ACM) that will be impacted by renovation or demolition activities must be removed by a Montana-accredited personnel from the facility and properly disposed of at an appropriate landfill. All asbestos-related activities and demolitions of facilities or portions of facilities must be notified to the Asbestos Control Program two weeks prior to the start of any activity that will impact ACM.

The following forms are used for applying for and obtaining project permits, making notifications, and applying for and obtaining an annual permit. Also available is a Waste Shipment Record form. PLEASE NOTE: For MTACP01, MTACP02, and MTACP03, all fields are required to be completed. The first and last name of a contact person at the site is required for department inspections of asbestos-related and demolition activities at the site.

  • Demolition with Asbestos Project Permit Application Notification, MTACP01. Use this form when you have an emergency renovation application, or an ordered demolition, or a combination of asbestos activity and demolition/renovation activity, or for courtesy notifications. (PDF) (Word)
  • Montana Demolition Notification, MTACP02. This form is to notify of the demolition of a facility and NO ACM has been identified in the facility nor is there any ACM being left in the building. If load-bearing structures are being removed and the facility is not being demolished or ACM is being left in the building, you must use Form MTACP01. (PDF) (Word)
  • Montana Asbestos Project Permit Application, MTACP03. Use this form for asbestos-related activities for ACM that is regulated and no other demolition/renovation will be conducted at the site. Activities covered by this form are listed under the "Type of Activity" section at the top of the form. (PDF) (Word)

  • OVERVIEW
    • An asbestos containing material (ACM) is any material that contains more than 1% asbestos;
    • An asbestos project is the encapsulation, enclosure, removal, repair, renovation, placement in new construction, demolition of asbestos in a building, or the transportation or disposal of asbestos-containing waste;
    • An asbestos project involves impacting 3 or more square or linear feet of ACM;
    • A Montana Accredited Asbestos Inspector must inspect building renovations and demolitions for ACM prior to renovation or demolition activities;
    • ACM that will be impacted by renovation or demolition activities must be removed before demolition or renovation activities begin;
    • The Asbestos Control Program must be notified 10 working days prior to asbestos project and demolition activities;
    • Asbestos projects require a project permit from the Asbestos Control Program and must be done by persons with a Montana Contractor/Supervisor or Worker accreditation.
