Motor Vehicle Recycling and Disposal Program | Notice of Public Hearing on Proposed Rule Amendment April 18, 2024 | Comment Period Closes April 19, 2024

Rulemaking Background: The Department of Environmental Quality (DEQ) is proposing an amendment to Title 17, chapter 50 of the Administrative Rules of Montana, pertaining to the Montana Motor Vehicle Recycling and Disposal Act at Title 75, chapter 10, part 5, MCA. Among other things, this Act authorizes the department to adopt rules for reimbursement of charges by tow truck operators for removing abandoned vehicles at the request of law enforcement. DEQ proposes to revise ARM 17.50.213(3) to increase the flat rate reimbursement amount to operators from $125 per vehicle removed to $175 per vehicle removed. The last increase for the removal of abandoned vehicles was in 2019.   

In February 2024, DEQ released a draft proposal and held an informal public stakeholder meeting to solicit input on the proposed rule package, answer questions, and address concerns. DEQ is not proposing to raise fees through this rulemaking.

Public Hearing:  On April 18, 2024, at 10:00 a.m., DEQ will hold a public hearing in Room 111 of the Metcalf Building, 1520 East Sixth Avenue, Helena, Montana, to consider the proposed amendment and adoption of the above-stated rules. Interested parties may also attend the hearing electronically in the following ways:
